WAIVER AND RELEASE AGREEMENT

This is a release of liability and waiver of certain legal rights. In consideration for myself and any other participants in my group being permitted to participate in the activities of fishing and boating, I agree to the following Waiver and Release:

I acknowledge that fishing has inherent risks, hazards, and dangers for all participants, including myself and anyone in my group, that cannot be eliminated. I UNDERSTAND THAT THESE RISKS, HAZARDS, AND DANGERS INCLUDE WITHOUT LIMITATION:

• Water hazards in boating and wading in rivers, bays, oceans, lakes, and other bodies of water, including drowning;

• Hiking in rugged country;

• Injuries from fishing equipment and other participants;

• Encounters with wildlife, animals, plants, and insects;

• Temperature extremes;

• Inclement weather conditions and unavailability of immediate medical attention in case of injury;

• Risk of contracting viral or bacterial illness and diseases.

I understand the risks, hazards, and dangers of fishing and have had the opportunity to discuss them with Battenkill Outfitters. I understand that these activities may require good physical conditioning and a degree of skill and knowledge. I believe all participants in my group, including myself, possess the necessary physical conditioning, skill, and knowledge to engage in these activities safely. I understand that I have responsibilities. My participation and that of any participants in my group in this activity is purely voluntary. No one is forcing us to participate, and we elect to participate despite the risks. I am voluntarily using the services of Battenkill Outfitters and their subcontractors on behalf of myself and any participants in my group.

WITH FULL KNOWLEDGE OF THE INHERENT RISKS, HAZARDS, AND DANGERS INVOLVED, I HEREBY ASSUME AND ACCEPT ANY AND ALL RISKS OF INJURY, SICKNESS, PARALYSIS, OR DEATH FOR MYSELF AND ANY PARTICIPANTS IN MY GROUP.
